It's obvious that various types of electronic interference negatively impacts the efficacy of drones. It's my feeling that there are some types of targets (Radar Arrays, tanks, artillery, etc.) which are safely recognizable by their shape, heat profile, etc. which should reduce the liability issue.

The distinction between human-directed drones and Lethal Autonomous Weapons Systems (LAWS) isn't about whether bad actors will commit war crimes, but rather about accountability, software limitations, and systemic risk under International Humanitarian Law (IHL).
When human operators deliberately target civilians, as seen in Russian drone strikes in Ukraine, it is unequivocally a war crime under IHL principles of distinction and target selection. However, fully removing human judgment from the loop introduces unique legal, moral, and technological complications.
1. The Accountability Gap
• Human-Directed: If a human operator targets civilians, there is a clear perpetrator. That person (and the commanding officer who gave the order) can be prosecuted for war crimes.
• Fully Autonomous: If an AI algorithms makes an illegal targeting error, identifying legal responsibility becomes extremely difficult. It creates a vacuum of accountability: can you criminally prosecute the commander who activated the drone, the software engineer who wrote the code, or the defense contractor? Under current legal frameworks, machines cannot possess criminal intent (mens rea).
2. Algorithmic Inability to Satisfy IHL Principles
IHL relies on two core principles that software currently struggles to replicate:
• Distinction: Differentiating between an armed soldier, a civilian holding a tool, or a combatant who is attempting to surrender. Algorithms process data patterns, not human nuance, surrender gestures, or complex context.
• Proportionality: Weighing whether expected civilian harm outweighs the direct military advantage gained. This requires subjective human value judgment, something code cannot authentically compute.
3. Moral and Ethical Thresholds
• Digital Dehumanization: Ethicists argue that delegating the choice to kill a human being to code strips the victim of basic human dignity. A human making a bad or malicious decision still operates within the human moral realm; an algorithm reduces human life to binary data.
• Lowering the Barrier to Escalation: Without risk to their own troops or the psychological weight of pulling the trigger, states may be incentivized to enter conflicts faster, drastically escalating global instability.
