Subject: Re: MI AG Indicts 16 Fake Electors
Yeah, they're in real legal trouble.

Here's the thing - a few of these fake elector sheets at least had the good sense (if not honesty) to make it clear on the document that their status as electors was contingent. For example, the submittal from Pennsylvania reads:

"WE, THE UNDERSIGNED, on the understanding that if, as a result of a final non-appealable Court Order or other proceeding prescribed by law, we are ultimately recognized as being the duly elected and qualified Electors for President and Vice President of the United States of America from the State of Pennsylvania, hereby certify the following....."

See, that kind of works. It's not an assertion that they are the Electors for President - it's stated as a possibility that they might be named as Electors following a legal proceeding. Thus, their action is arguably an effort to preserve the possibility of effectuating a court order (or other proceeding) by getting the paperwork in, rather than an effort to deceive.

Unfortunately for the Michigan folks, their fake elector sheet doesn't have any of that contingent language. It flat out just says that they're the electors.

"WE, THE UNDERSIGNED, being the duly elected and qualified Electors for President and Vice President of the United States of America from the State of Michigan, hereby certify the following....."
