The tanker crews, presumably, are not the "narco-terrorists" the regime claims we are in a "war" with. So, they need to claim some sort of legal justification for seizing the tankers, otherwise they would, literally, be pirates.

Or it’s a TACO response after China objected strongly to the second tanker hijacking, and maybe made some credible threat behind the scenes.
