The Beeb was reporting on this case last night. The Appeal will probably go to the Fifth Circuit, which is also right wing. The Beeb also reported the Fifth Circuit is overturned more than any other appeals court in the country.

The U.S. Supreme Court has frequently overturned the Fifth Circuit in recent terms, reversing its decisions at a rate between 66% and 75%. Historically, however, the Fifth Circuit’s overall reversal rate sits much lower—around 10% or less—because the high court only hears a tiny fraction of its total cases.
Seems that, if the Fifth affirms the trial judge's sentence, it will be overturned by SCOTUS on "cruel and unusual" grounds, if what we see posted on this board, about people being given decades long sentences, for expressing their opinion, without violence, is true.
