I can see that point of view. On the other hand, our people are supposed to be "better" than that. I also wouldn't want to send them to the Hague. Maybe just a court martial, like Lt Calley. At most. Though, Hegseth is the "Calley" of this situation, issuing the orders. I don't think any of Calley's men were convicted (though several of his senior officers were implicated, including in the cover-up).
