The corollary: Two party rule usually saves each party from the excesses of itself.
However, in our current moment in history, control of a compliant Supreme Court may give enough cover for an authoritarian President and submissive Senate to overcome the opposition of a House held by the Democrats- assuming for the moment that Dems actually take the House.
I have little doubt that the originalists on the Court will come up with some truly original justification for completely sidelining the House if it is held by the opposition.
They might not even need to come up with snything new. Their previous opus of original and novel thought on the issue of presidential immunity may already provide the framework for neutering the House. If there’s a crack in the wall, trust the same lawyers who straight-faced agreed that the president can send Seal Team Six to assassinate a political opponent….to find and exploit it.
But rest assured- it will all be “legal” if they do it.
