Under your view of the statutes, the deliberate transmission of classified national defense information over an unsecured unapproved commercial app to non-secured devices isn't just incompetence - it's criminal behavior that merits prosecution. The inclusion of Goldberg was an inadvertent mistake; but the choice to transmit that specific information through that specific channel intentional. Under your view of the law, at a minimum Waltz and Hegseth committed crimes, not merely incompetence.
