Why would they need access to the code at all? I thought they wanted to look at the payment data, not the code.

I have a feeling that Musk intends to copy the data and code base to one of his own servers and his programmers will rewrite the code with new rules and priorities in order to replace the entire system. That's what I'd do.

Then they can still say: see, we only read the original data and code, which will be technically true.
