Aye, the second amendment got bastardized. To get an individual right to keep and bear arms, the prefatory clause was deemed introductory and had no affect on the meaning of the operative clause. But the previous decisions that depended on the prefatory clause having meaning and modifying the operative clause and allowed military grad weaponry haven't been altered. So now we have the best of both possible gun worlds - an individual right to keep and to bear, and collective rights to military grade weaponry. Scalia's use of the M16 as a dangerous weapon that can be regulated in Heller's dicta, is ignored. And now it's gospel, in spite of Clarence.
