DOJ legal counsel claims President can rescind national monuments - On June 10, the Department of Justice’s Office of Legal Counsel released a legal opinion titled “Revocation of Prior Monument Designations,” arguing that Presidents can revoke or change national monuments. This runs counter to a 1938 ruling that monuments created under the Antiquities Act cannot be revoked. In the legal opinion, Chuckwalla National Monument and Sáttítla Highlands National Monument (managed by the Bureau of Land Management and U.S. Forest Service, respectively) were singled out for barring oil and natural gas drilling and mining.
