Who authorized transporting to the ER? I'm assuming he wasn't ambulatory to do it himself.

Whoever did (e.g. the facility) should be responsible. Mom's facility was quite familiar with hospice care, and knew what to do (and what not to do). If they had sent her to the ER, I'd be raining down all over them.
