Interesting piece. I note that the 14th Amendment was cited in at least one prior decision (i.e. fetuses were not considered persons under that Amendment). As I understand it, the anti-abortion people are trying to do it. But they are overlooking the obvious. If a fetus is determined to be a person under the 14th, then it can be argued that the 13th applies, which invokes forced servitude. Which the anti-abortion people won't want, because that would mean abortion has to be allowed (or you're forcing the woman into servitude against her will).
