I see this morning that some legal minds are arguing that the appointment of Lindsey Halligan to her position as United States attorney was invalid under 28 U.S.C. § 546.

That view is supported by a 1986 OLC opinion written by Samuel A. Alito.

Evidently, as written, Congress intended to confer on the attorney general only the power to make one interim appointment and that any subsequent appointment would have to be made by the district court.

And if true, the statute of limitations for a Comey indictment ended at midnight last night.
