I did find this. It reads to me that a jury trial is necessary for the death penalty to be imposed.

No, prosecutors before the trial chose not to pursue the death penalty against Jose Ibarra but, according to Associated Press reporting this month, did notify the court in a filing that they were seeking life without parole.
Under Georgia law, a death penalty sentence cannot be given by the court unless "the jury verdict includes a finding of at least one statutory aggravating circumstance and a recommendation that such sentence be imposed." (O.C.G.A. § 17-10-31) However in this case there was no jury, and O.C.G.A. § 17-10-31 stipulates that "this Code section shall not affect a sentence when the case is tried without a jury or when the judge accepts a plea of guilty."
O.C.G.A. § 17-10-30 meanwhile states: "The jury, if its verdict is a recommendation of death, shall designate in writing, signed by the foreman of the jury, the aggravating circumstance or circumstances which it found beyond a reasonable doubt. In nonjury cases the judge shall make such designation."

Fox trades in stories about the venality of big government, criminal activity by immigrants (real or imagined), liberal overreach and little-guy heroes of the heartland.
Fox stories deftly push emotional buttons, lest the viewer push the buttons on his or her remote...
This format has been successful financially, but it has drawbacks. There's a lot that goes on in the world that doesn't easily fit the Fox template.
There are important stories that don't make anyone angry, prove liberals and immigrants are evil or otherwise carry an emotional punch. Fox viewers get none of them.
Fox News is like an all-you-can-eat buffet, that serves up only red meat.
A more balanced diet might be healthier in the long run.

I remember when the GFC hit, FOX News had a continuous loop of illegals climbing up a very steep area and getting around obstacles. It would play over and over again for a little bit in the background of each news slot. There was a half black, half-Samoan guy who lost everything where I lived who was very upset about illegals. After making an attempt to start a business, her abandoned his Sting Ray boat and headed back West to work in RVs again. Up till then I hadn't really felt a resentment around me about illegals, but it continued. What was interesting was the during the GFC, a lot of the illegals headed home. The data showed it. If they were up north they would just let themselves be caught and get a free plane ride to the border.
I mentioned that to the Samoan/Black and he got very angry and intimidating. He apologized later. And since then there's been a huge resentment about illegals. I read recently that Biden was under the influence of Latino Activists when he took office and initially took down a lot of the Trump immigration barriers. The plan was to get the Latino vote and it failed. If so, we are seeing part of the product of that failed policy. I'd like the flow stemmed, but I want to be humane and I'd like the restrictions to not be contrived and if we need to reinterpret the Geneva convention, let's get an agreement on a reinterpretation.
