Who's the fascist party, again? Tell me.
Which party just loooooves the Constitution, again?
The democrats will always tell you who they are. And who they are is a party that will do whatever it wants, whenever it wants.
https://apnews.com/article/albuquerque-guns-govern...SANTA FE, N.M. (AP) ' New Mexico Gov. Michelle Lujan Grisham on Friday issued an emergency order suspending the right to carry firearms in public across Albuquerque and the surrounding county for at least 30 days in response to a spate of gun violence.
The Democratic governor said she expects legal challenges but was compelled to act because of recent shootings, including the death of an 11-year-old boy outside a minor league baseball stadium this week.Of course. Fascists are always 'compelled to act' when they fail at their jobs.
Tell me again how democrats respect the Constitution?
There's only one way to deal with this is you live in New Mexico, and that's to not comply.

This is today's democrat party, folks.

There will be legal challenges, and she will lose them (most likely). I don't follow NM politics, so have no idea what's going on over there. At first blush it seems like a not-well-thought-out reaction to a problem.
Though I believe there are lots of places you can't carry them. Can you open-carry in Seattle? You can in Arizona, of course. I don't think so in NY, but I could be wrong.
I would like the 2nd repealed, but until that happens this sort of seems looney simply because it will create a fuss without any tangible results (i.e. no one arrested for this will serve any jail time, they will have to expended resources in the courts, etc., and will end up with nothing).

No governor short of declaring Martial Law for a REAL EMERGENCY has the right to suspend or even brush up against all or even the smallest part of the Constitution. The solution for her 'emergency' is for local authorities to arrest the perpetrators.
She doesn't just get to decide to curtail rights because her job is too hard.
This is clearly an impeachable offense, and she needs to be removed from office. Amd any police officer or official who goes along with it should be fired.
The 2nd Amendment isn't going anywhere.

This is also a test case for other blue state wannabes - and Joe Biden - to see what can be gotten away with.
Governors like Gavin Newsom and Jay Inslee would sell their souls for a chance to do something like this in their states. As would Biden'nationwide.
Climate emergency declarations, here we come!

Very likely there will be, and very likely the ban will be struck down.

Sure, but what options exist to get 'well regulated' back in front of a court?
She could argue that the violence she is responding to is a result of inadequate regulation as is called for in 2A. That she is doing it civilly with a pen, not a gun, is entirely reasonable and commendable....even if the the ideologues appointed by the fraud committing lying, cheating orange rapist rule against the NewMex ban.

Nothing? Quite the contrary. Virtue has been signaled. A reward unto itself and who knows what sort of boost this will give to Michelle Lujan Grisham's political aspirations.

If I were a NM voter, I would not be happy. And, as I've said, I would be OK with repealing the 2A completely. But this will just cost money, and there's a good chance that cases against actual bad people will get tossed because of the illegal arrest.
Stupidity isn't a virtue. If they had crafted something clever, defensible, then maybe it would be worth doing. But, from what I understand, this just isn't.

I've been under this many times: In times of disaster or civil unrest, a declaration of emergency is more common than a declaration of martial law because it is easier to reverse. An emergency declaration allows the government to expand its powers temporarily to deal with a crisis, suspending some civil liberties but avoiding military control. Wiki
She doesn't just get to decide to curtail rights because her job is too hard.
As a Governor, she does have that power, which she can't use lightly - politics, etc.

I'm not sure if NM has the ability to recall a Governor, but that might be a route. If you want a spate of lawsuits, fire officials who follow it. You'll lose too.

No, but we can get saner interpretations of it.

Emergency powers are supposed to be used in the event of, I don't know, an emergency.
This isn't that.
I shouldn't be surprised how many here are ok with this. If Trump had said in 2020, "I'm declaring a national emergency to get control of the rioting going on in our cities" there was FAR more justification for that then this nonsense in New Mexico.
The best part is, democrats would have demanded he resign immediately.
No, but we can get saner interpretations of it.
Bruen and Heller I*are* the sane interpretations of it. You're not getting anything else.
And even if you did, there won't be any compliance.
What this will take is one simple silent protest in downtown Alburquerque of a bunch of folks openly carrying. Have your $5000 ready (that's the civil fine she set because she can't charge anyone with a criminal offense) and dare any cop to arrest you. The city and county cops have already said no, we're not enforcing this.
Then when the State Police show up, have your lawyer on speed dial ready to file the multi-million dollar civil rights lawsuit in federal court. That $5k investment will net you several hundred thousand once the state is forced to settle out of court...and pay.

No state in the union can suspend the federal Constitution. There is no such thing as a state public health emergency exception to the U.S. Constitution.Exactly.
Good for Ted. Finally, a democrat says something that's not 100% insane; it's refreshing to know that at least 1 member of that party has at least heard of the Constitution.

I'm pointing out to you that she does have emergency powers. I don't agree with her use of emergency health powers, but for reasons Thomas Jefferson pointed out.

Heller is good, Bruen I see as unworkable. But many righties don't understand that rights exist in tension with other rights, and that society has rights too. The Governor is about to find out why Jefferson advised against it at this low a level.
You see, to me, the 2d Amendment isn't sacred. You can suspend my right to carry for 30 days and it won't bother me. I'll just comply without whining about it. If there seems to be a break down in order, I'll cooperate. I may question the usefulness or validity of it, but I'll comply.
Here's Jefferson:
Acting beyond the written Constitution was not for the weak of heart or the
low in status. Obeying the higher law of protecting the nation was a duty of
the highest elected officers, not those 'with petty duties.' 132 It could only be
called upon during genuine moments of crisis, not when 'consequences are
trifling, and time allowed for a legal course.'133 When less dangerous times
were at hand, 'overleaping the law' was worse than 'a strict adherence to its
imperfect provisions.'134 During such times, the elected leader exposes
himself to a sharp backlash if he misjudges popular opinion. 'It is incumbent
on those only who accept of great charges, to risk themselves on great
occasions, when the safety of the nation, or some of its very high interests are
at stake.'135 Jefferson trusts that his fellow Americans would be forgiving;
they would 'put themselves in his situation' and judge his decisions based on
what he knew at the time.1 (Jefferson believed he acted beyond the Constitution a few times)

I'm not passionate on gun rights. I don't want them taken away, but I think Liberals have destroyed family and culture so much - that many Americans can't be trusted with a gun.
So I sort of go back and forth on this one.
But this ban - yes - does confirm worst fears. I differ with the Right in that if there was bans on assault style or other weapons whose only job is mass killing - I'd support it. BUT - this move shows that the Stalinists don't want the public to even have basic arms or defense.
Who knows?
Our side IMO screwed up with Roe v Wade and helped bring out the vote in 2020 for Dems.
Maybe with the right nominee this New Mexico thing might help in the same way?

I'm curious how you think liberals have done this?
I do agree that many Americans can't be trusted with a gun. Especially those that have their heads so far up the right-wing conspiracy theory Q-blogosphere that they can't distinguish reality from fantasy (not saying anyone here is like that...but we have numerous examples in the media, including at least five of which are being sentenced this past week and next week). They have been so primed by Alex Jones, and his ilk, that they are on a hair-trigger. A lot of people have no business owning firearms, but we have no mechanism for screening them (e.g. the "crazies", often referred to by the right as people who shouldn't be able to buy one).
I don't know, and really don't care, what the NM law is on governor's powers. I agree with Lapsody that it was probably an unwise move, and the governor may pay for it in the polls. Maybe you are correct that there will be a RED backlash. That's NM's problem. I do think you are, at the very least, hyperbolic calling the governor a "Stalinist". I suppose she could be, but I doubt it.
Also, I will again point out that the ban is on carrying in public. Not possessing. Last I knew there were a lot of places you couldn't carry. Like all schools, any federal facilities and governmental buildings, etc. A quick check reveals that open-carry is illegal in FL(!!), IL, NY, HI, and parts of CA. Several more states require permits for open-carry. Some variability between pistols and "long guns" (e.g. TN bans open carry of long guns). NM allows both with no permits.

BTW Donald Trump and Mike Pence were endorsed by former KKK leader David Duke and by the "Crusader" the official newspaper of the KKK. (Is this the culture you're referring to?)
Joe Biden and Kamala Harris were not.
When your political ideology is a homophobic, misogynistic, xenophobic, Leave It To Beaver trip back to the 1950's and you're voting for the same folks as the KKK and the Nazis,

I did hear something about the Army saying a lot of youth are not fit to serve in the armed forces. Pretty sure that was true under Trump, too. Maybe under Obama, and even Bush II. I don't think either party can be blamed for that. If parents unplugged all the toys, and made the kids go outside, that would help. Team sports is also highly beneficial (1poorkid was a fullback in a soccer club...helped keep her fit, and team sports has been shown to have psychological benefits as well; and there are other options -like the "Y"- if parents can't afford a "travel team" club). 1poorkid didn't have a smartphone until she bought one herself. I gave her a texting phone (Nokia 6800:

When I was in the Navy, one big inducement was saving for college. The military would match your savings. Today,

If I were you, I'd be more concerned about the Navy (I'm more familiar with them) fighting the last war. We did the same in WWII. Emphasis on big battlewagons in the beginning, until the Japanese taught us the future was naval airpower. Today, they're doing it again. We need smaller, more nimble ships to patrol areas like the South China Sea. Carrier battlegroups are made for larger bodies of water, and different sorts of combat. They are building more Arleigh-Burkes, but they should probably be thinking even smaller and faster.
Again, I don't think either party can be blamed for that. Our military has a history of being slow to learn. Hopefully we're watching the Ukraine conflict closely, because the Ukrainians are redefining the battlefield, using drones with surprising effectiveness. And not just for surveillance. Our Navy should also be paying attention to the use of drone boats.

I didn't like setting a deadline, per se, but we needed to leave. And he got the ball rolling. There wasn't really any clean way to do it. Given the rapidity that the Afghan forces folded, they were never going to be ready. I would have preferred getting our Afghan helpers out in a more orderly fashion, and more completely. Grisham went on CNN no doubt expecting hosannas and a softball interview.
CNN didn't give her any of that. Instead, they committed a random act of journalism:
https://twitter.com/RNCResearch/status/17016121697..."What if a Republican governor of a state declares a health emergency and unilaterally outlaws abortion in that state, where the legislature has not done so by statute ' following your logic, would that also be sound?"
New Mexico Democrat Gov. Michelle Lujan Grisham: NoWhat's actually brilliant about that question is that a Republican governor actually has great Constitutional grounds to stand on.
https://twitter.com/RNCResearch/status/17016103182..."We also have, Governor, the Constitution ... and you're an attorney. Do you think you're on solid constitutional ground?"
New Mexico Gov. Michelle Lujan Grisham: "I have the right"
"But where is the right?"
Lujan Grisham: "We'll see what all of these court actions do"I'll answer for her: She has no right, and even now her Attorney General has said he's not enforcing this, so that takes her State Police threat off the table.

As I mentioned in a previous post, several states ban open carry without a license. So I don't really see that there is a Constitutional issue, or no state would be allowed to do that. I still think she'll lose in court. Unless NM has some particularly broad gubernatorial powers in their laws. Which they might, though I'm guessing not. NM is between TX and AZ, and we both have old-west gun laws.**
**Though I think AZ reformed a few of them after a series published in the AZ Republic on our gun laws (maybe 40 years ago, now). One I remember was that if I saw someone standing on a public street holding my TV, I could shoot him dead. BUT...big BUT...I would have to prove that it was my TV. If I could do that, it would be a "righteous shoot". I think that law has since changed. A local lawyer used to have a column in the paper (Van O'Steen, IIRC).
