If so, that's not really a lawsuit - it's the DOJ appealing sentences in the various individual cases. They are allowed to do that, though it's unusual for the DOJ to appeal a sentence as too light (it's usually the defendant challenging a sentence for being too long)

Yes, that's it. Memory imperfect - which is also why my google-fu didn't work. :) I puzzled over that and thought maybe they might send the case back down again for a determination "consistent with this opinion". But I've never seen that. I also wonder if it was a way to send a message to the courts. And then I realized I'd never seen that either - but there might be some of that during the KKK eras.
