Illegal aliens are criminals. They broke our laws. -

It depends LM. I've read that the first time it's a misdemeanor, but if they're deported and come back, it becomes a felony. So why doesn't ICE pick them up when they're ordered to depart? So I'm not sure they are a criminal the first time, but the second time - yes.
