Mistakenly deported Salvadoran native Kilmar Abrego Garcia has been brought back to the United States where he will face criminal charges for allegedly transporting undocumented migrants within the U.S.

A two-count indictment, which was filed under seal in federal court in Tennessee last month and unsealed Friday, alleges Abrego Garcia, 29, participated in a yearslong conspiracy to haul undocumented migrants from Texas to the interior of the country.

The alleged conspiracy spanned nearly a decade and involved the domestic transport of thousands of noncitizens from Mexico and Central America, including some children, in exchange for thousands of dollars, according to the indictment.

From your link: The Trump administration has acknowledged in court filings that Abrego Garcia's removal to El Salvador in March was in error...

The other puzzling aspect of this case was always this: If Abrego Garcia committed a crime, why wasn't he simply charged and tried?

The answer is also right there in your link: the Trump DOJ only began the investigation of Abrego Garcia in April, a full month after he was disappeared to El Salvador's CECOT mega-prison -- despite a 2019 court order barring his deportation.

In short, they didn't indict him and try him because they had no evidence he had committed any crimes.

Looking over the indictment, there are a lot of allegations that he was involved in a lot of very serious crimes and references to multiple "co-conspirator" statements but what is he actually charged with?

Look, this is simple: If Abrego Garcia committed crimes he should be charged and tried. Despite your nonsense, no one is suggesting otherwise. But it looks like the indictment hinges mostly on the word of jailhouse informants.

So your smugness may be a little premature.

Finally, the "left's" only interests are in following the rule of law and the Constitution, democratic principles many on the right seem only too happy to abandon.

And by the way, this isn't going to take the spotlight off of the girls' feud: the Elon and Mad King Donald break-up is still headline news.

No, I'm just not accepting the premise of your reply (that AG's deportation was somehow 'vigilantism'. It wasn't.)

AFAIK, the only ruling by a judge of illegal behavior at this point is against the Trump administration.

He was under a deportation order. The order said, "don't deport him to El Salvador", that was the error.

Well, my guess is that an investigation was going on of AG, he was arrested in the past driving a van full of people - their was an implication it was smuggling but nothing solid in what I read. Trump needs a distraction from his Musk spat, so AG is now back in country and Trump will get so good mileage out of it. No longer will the BBB be the focus of attention. If AG did it, fine, convict him and jail him/deport him.

Hundreds, possibly thousands of people's lives will be ruined, but if we afford them due process and follow the law not much can be said. Instead we will Steve Miller it.

The guy hasn't lost in court at all in order to stay in the U.S.

The only party that has repeatedly lost in court was the lawyers looking to defend the Trump administrations illegal actions (hence the vigilante quip you misunderstand).

Here's a review of conspiracy law by Empty Wheel and then she applies it to the KAG indictment.


CONSPIRACY LAW – EIGHT THINGS YOU NEED TO KNOW.

One: Co-conspirators don’t have to explicitly agree to conspire & there doesn’t need to be a written agreement; in fact, they almost never explicitly agree to conspire & it would be nuts to have a written agreement!

Two: Conspiracies can have more than one object- i.e. conspiracy to defraud U.S. and to obstruct justice. The object is the goal. Members could have completely different reasons (motives) for wanting to achieve that goal.

Three: All co-conspirators have to agree on at least one object of the conspiracy.

Four: Co-conspirators can use multiple means to carry out the conspiracy, i.e., releasing stolen emails, collaborating on fraudulent social media ops, laundering campaign contributions.

Five: Co-conspirators don’t have to know precisely what the others are doing, and, in large conspiracies, they rarely do.

Six: Once someone is found to have knowingly joined a conspiracy, he/she is responsible for all acts of other co-conspirators.

Seven: Statements of any co-conspirator made to further the conspiracy may be introduced into evidence against any other co-conspirator.

Eight: Overt Acts taken in furtherance of a conspiracy need not be illegal. A POTUS’ public statement that “Russia is a hoax,” e.g., might not be illegal (or even make any sense), but it could be an overt act in furtherance of a conspiracy to obstruct justice.

Conspiracy law allows prosecutors to hold one cog in a larger crime responsible for the actions taken by everyone else with whom he entered into a conspiracy — and the agreement can be implicit (see Rule One). Once prosecutors show that a person has entered into a conspiracy — here, to transport migrants first into the US and then around the US — then he is on the hook for everything else his conspirators do. Conspiracy law allows prosecutors to rely on communications from some members of a conspiracy without requiring them to take the stand to validate those communications.

Two more points. First, it is totally normal for DOJ to refer to co-conspirators anonymously as they do here. In addition, it is not at all unusual for DOJ to throw a great deal of energy — such as (hypothetically) a cooperating agreement with CC1 and possibly even favorable treatment of CC6 to substantiate a case against a lesser member of a conspiracy if they want. That’s likely what happened here.
