This is likely being done for strategic reasons. They simply informed the court that they would not use this evidence in their "case-in-chief." However, if Trump testifies, that evidence and these witnesses could be used to impeach him or could be presented on rebuttal.

What Carroll's lawyers are doing is a tactic where they are essentially daring the defendant to testify and lie so they can make him pay dearly for it if he does, while also dangling a carrot to him to entice him to not testify since the evidence could not be offered at all if the defendant doesn't testify or put on a case. This kind of a move is normally only done when a plaintiff feels extremely confident in how their case has gone up to this point. They are basically saying that they have a lot more they could present that will hurt him, but they will leave it right here if the defendant doesn't testify or put on a defense.

In short, Carroll's lawyers want this to go to the jury right now without any more foolishness from Trump, and are very confident in the outcome.<snip>
