Surely the statement made by Abel at this year’s meeting admitting to exceeding the agreed upon carloads has triggered this.

The Swinomish Tribe filed the lawsuit in 2015. BNSF had already stipulated it was trespassing. The only thing to be decided was the amount of the damages. The judge concluded the damages were equal to the amount of profit BNSF made by trespassing.
