Yesterday, representative Marjorie Taylor Greene flashed nude photos of Hunter Biden during the House Oversight Committee's hearing featuring two IRS whistleblowers. Greene is likely protected from any legal action by Hunter Biden due to her and all members of Congress being protected by the Speech and Debate Clause of the Constitution.
But...
People are saying that she used the stunt and photos in a fundraising newsletter (electronic or print). If so, Hunter Biden would be within his rights to bring legal action.
Perhaps legal eagles here can confirm that in Hutchinson v. Proxmire, 443 U.S. 111 (1979), SCOTUS said the Speech and Debate Clause doesn't extend to newsletters.
