Tarkin was giving the orders (emperor wasn't present on the first Death Star). When Vader assaulted a member of the command staff, Tarkin commanded "Vader; release him".

Though Vader also displayed initiative, not requiring orders. In later movies he was giving orders (to fleet admirals, etc).
