The week's question
In December 2024, in the thread "Re: BRK: Why Not XOM?", BreckHutHigh asked the members: "What about the long road trips with kids?" This week it is put to everyone again. The button below opens the small thread re-asking it - read what others have said so far, then give your own answer as an ordinary reply.

I thought the immunity was just criminal. Emoluments is more akin to civil liability.

"In Trump v. United States, the Supreme Court ruled that former presidents have absolute immunity from criminal prosecution for actions within their core constitutional powers, presumptive immunity for other official acts, and no immunity for unofficial acts."

Trump has immunity for all official acts. And who gets to decide what's an official act? Himself and his supreme court, of course. If it ever comes to court, Trump will naturally argue that everything he did as president is an official act, including farting and changing his diaper. As for emoluments, they are a constitutional issue, subject to impeachment. You can't sue someone under civil liability unless you can show that you were hurt personally. On the other hand, if the emolument was a bribe, it's a criminal offense that is covered by immunity. "Criminal you lose, civil liability I win".
