Up until he participated in that video, Kelly may have been qualified to be Sec. Def.
But once he decided to take the position of implying illegal orders where none were given, to foment dissension and insubordination in the ranks simply for his own political advantage, he disqualified himself.
And yes, since he's undoubtedly getting military retirement pay, he is definitely at risk if he is court-martialed.
By the way, being "investigated" doesn't mean he will be court-martialed, and being court-martialed doesn't mean he will be convicted.
It's all Rule of Law stuff of course. You guys like that.
