wondering if this should be prosecuted as a hate crime, but suspect as you mention "qualified immunity" gets him off.


Unless they find a treasure trove of hate stuff on the internet, I'd just see if a case could be built for normal crimes or malfeasance. He violated his training protocols, there was no reason to draw the weapon, no reason to flop partly in front of the SUV,etc. All of the actions could be normal bad judgement. Can they prove a crime happened? The state needs evidence and they're locked out, so getting to beyond a reasonable doubt is more difficult and federal qualified immunity stops the civil suits.
