Perhaps. This seems like a bit of a novel theory, so I don't know how well it will hold up. But I think a criminal referral was inevitable no matter what Fauci said, given Paul's stated desire to put him in prison, so this may be the most advantageous strategy.
But again, this is why you and your interlocutors are talking past each other. Not because they're dumb or wrong, but because the legal basis for Fauci's Fifth Amendment assertion is not obviated by the prior pardon.
