A defendant like the Atlantic and the journalist(s) involved cannot afford to go to trial after full discovery. It is without any question that when Patel's attorneys rummage through all the Atlantic's emails, text messages, and so forth, the contempt and hatred for Trump and Patel will be blazingly obvious.
Even if contempt and hatred were found, that's not the standard:
The lawsuit alleges the publication acted with “actual malice,” a legal standard that requires public figures such as Patel to show the publisher knowingly printed false information or recklessly ignored doubts about its accuracy.
It's likely true, as it's coming out a lot of people know it. What I'm curious about is who pays for Patel's suit? Is that a function f group Republican money? Or is it just Patel?
