It's a specific intent crime. You're totally allowed to get rid of anything you want, as long as it is not for the purpose of blocking the government's efforts to search it or seize it. So this would only apply in situations where the search or seizure was underway, or where it was imminent and you knew it was imminent.
This. You're allowed to shred all the documents you want, anytime you want, so long as you know that what you're shredding isn't the subject of a case where destroying said documents would land you in hot water.
Companies have retention/deletion polices as well for documents and meeting recordings/transcripts. For years it wasn't uncommon to hear somebody say, "They put a lock on my inbox again" as some lawyer was looking for some discovery material.
