I think part of it is people misunderstanding what an Executive Order is.
It's not a law. It's not a regulation. It's the President giving instructions to federal employees. It doesn't bind anyone outside the government.
In spite of someone's rudely calling me smart, I am among those who did not fully understand what an EO is.
With this additional understanding, the SCOTUS decision to take the appeal and rule as they did makes a bit more sense. It seems the lower courts erred in failing to find the lawsuit premature.
On the other hand, a new suit against the USPS rules issued under the EO in the last few days do seem ripe for trial. This rulemaking seems to more directly violate the states' rights regarding administration of elections. A suit by the states with a request for an immediate injunction seems like it would avoid all of the problems the USSC addressed in this ruling.
