there's no requirement that all crimes be in writing

As I re-read this, I realize this would be confusing. The U.S. has abolished "common law crimes." Now, all crimes have to be codified in actual criminal codes or statutes. Unlike the impeachment clause of the Constitution, which refers generally to "high crimes and misdemeanors," actual crimes have to be specifically defined with their elements enumerated and set out in a criminal code.
