Because there's a federal law pre-empting local regulation of national banking associations in favor of federal regulation. Absent such a federal law, the states are free to exercise sovereignty over contract law within their jurisdiction.

That's why arguments about just repealing the Macarran-Ferguson Act are a bit puzzling. Repealing the Act wouldn't take regulation of health insurance away from the states - it would just eliminate the presumption that federal laws that apply generally (like the anti-trust regulations) are not intended to apply to health insurance. But unless there's a federal law that pre-empts health insurance regulation by the states generally, they'd still have their ability to generally regulate it.
